The drama continues. While Apple may have just won a permanent injunction over the Galaxy Tab 10.1, it seems things are not so clear cut, and actually Samsung can pretty easily route around that injunction. You see, Samsung is not allowed to use their German subsidiary to sell or re-stock the German retailers with the Galaxy Tab 10.1, but Samsung can easily circumvent that by using either their subsidiary in Netherlands to sell to them, or even the South Korean one.

This is unbelievable, and it’s really starting to get ridiculous. Apparently Apple was so satisfied with the result of the first injunction in Germany, where they manipulated the image of the Galaxy Tab 10.1 to make it the same size and give it a more 4:3 ratio, so they can “prove” that the Galaxy Tab 10.1 is “virtually identical” to the iPad, that they decided to do it once again at the Court in Netherlands, this time for the Galaxy S smartphone.
Apple provided the Court with this evidence while trying to show “an example of the similarity relevant to copyrights.” [...]
It seems that Samsung has already managed to lift the injunction on its Galaxy Tab 10.1 throughout Europe (except Germany), at least for now. One of the first things that I found odd with the German Court putting an injunction on the Galaxy Tab 10.1, is that they managed to do it throughout Europe. I wasn’t aware that the EU had such a law where one, almost random, Court (Germany doesn’t even have the presidency of EU right now) can put an injunction on companies that will cover the whole EU.

Last week I was saying how the German Court’s decision to grant Apple an injunction over Samsung’s Galaxy Tab 10.1 makes little sense. Just because 2 products are somewhat similar “in the same product category” doesn’t mean one should be blocked out from the market. It’s how competition works in the real world. But it seems that even they may have been misled by Apple’s legal team.

Samsung and Apple have been at each others’ throats over patents for awhile now. The latest casualty in the entire mess was the Galaxy Tab 10.1. The Regional Court of Düsseldorf recently decided that the tablet should be banned from being sold in EU countries, a solid hit at its marketing strategy.
